Terms of Service and Disclaimer
By using the RealMbps website (https://realmbps.com) you accept these Terms of Service. If you do not accept them, please do not use the site. We recommend reading them carefully; they are written in plain language.
1. Subject of the service
RealMbps offers a free online tool to measure internet connection speed (ping, jitter, download, upload), a community leaderboard to compare anonymous results, and a series of informational guides on network technology, operators, Wi-Fi hardware and streaming.
The service is provided "as-is", without warranty of continuity, absolute accuracy or fitness for a specific purpose.
2. No warranty
The measurements provided by RealMbps are for informational purposes only. Despite the technical effort documented on the methodology page, results can be affected by factors outside our control (Wi-Fi, hardware, VPN, congestion, browsers, third-party devices). RealMbps does not warrant:
- Absolute precision of measurements
- Continuous availability of the service (maintenance and technical interruptions are possible)
- Adequacy of results for evidential or legal use against telecom operators (for that you need testers certified by the national regulator)
- Accuracy or currency of information in the guides (which reflect our knowledge at the time of publication)
3. Limitation of liability
To the maximum extent permitted by applicable law, RealMbps, its operators, authors and contributors will not be liable for:
- Direct, indirect, incidental, consequential or punitive damages arising from the use or inability to use the site
- Commercial decisions (switching operator, buying hardware) made based on the published information
- Data loss, loss of profit, reputational damage
- Third-party content (external links, advertisements)
4. Proper use of the site
You agree to use RealMbps lawfully and not to:
- Interfere with the operation of the site (mass scraping, DDoS, intrusion attempts)
- Publish offensive, illegal, personal-reference, spam or advertising content on the leaderboard
- Automate fake submissions or artificially inflate results
- Reuse the code or content commercially without permission
We reserve the right to remove published content that violates these conditions and to block access to IPs that abuse the service.
5. Intellectual property
The "RealMbps" trademark, the logo, the text of the guides, the measurement algorithm and the site graphics are the property of the site's operators. Short quotations with a canonical link to the site are permitted. Integral or substantial reproduction is not permitted without written authorisation.
Third-party trademarks mentioned (Cloudflare, Google, Netflix, BT, Verizon, Comcast, Deutsche Telekom, Movistar, Orange and others) belong to their respective owners and are cited solely for informational purposes, without sponsorship or affiliation (save as specified on the About page regarding Amazon Associates links).
6. User-published content
By publishing a result on the community leaderboard, you declare that the data entered (nickname, country, speed) is truthful and does not violate the rights of third parties. You grant us a non-exclusive, free and revocable licence to publish such data on the site. You can request its removal via contact at any time.
7. External links and advertising
The site contains links to external resources (documentation, third-party guides, operators' sites) and advertisements served by Google AdSense. We have no control over third-party content and assume no responsibility for their privacy practices or reliability. Some product links are affiliate links (Amazon Associates, tag mc0772-21): a small commission supports us at no additional cost to the user. Editorial recommendations remain based on technical criteria, not affiliate margins.
8. Changes to the terms
We may update these Terms of Service at any time. The date of the last change is shown at the top. We recommend reviewing them periodically. Continued use of the site after a change constitutes acceptance of the new terms.
9. Governing law and jurisdiction
These Terms are governed by Italian law (the operator's jurisdiction). For any dispute arising from the use of the site, the court of the operator's place of residence has jurisdiction, subject to the consumer's right to bring proceedings before the court of their own domicile under applicable consumer law. Consumers residing in the EU retain the rights granted by their national consumer law. Before taking legal action, we encourage you to contact us via the contact page to seek an amicable solution.
10. Final provisions
If any of the provisions of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect. Failure to exercise a right provided in these Terms does not constitute a waiver of that right.
